Agreement between user and NukeWorker.com

The NukeWorker web site is operated by NukeWorker.com, LLC ("NukeWorker," "we," "us"). It includes a nuclear industry job board, community forums, outage schedules and related data services, a photo gallery, and other tools and pages (collectively, the "Site").

The Site is offered to you conditioned on your acceptance of the terms, conditions, and notices below. By using the Site, you agree to these terms. Particular features, paid services, or offers may carry additional terms; where those conflict with these terms, the additional terms control for that feature.

Modification of These Terms

We may change these terms, the Site, and the fees for any paid service at any time. Changes take effect when posted. Your continued use of the Site after a change means you accept the updated terms, so please review this page periodically.

Acceptable Use

You may use the Site for its intended purposes, including searching and applying for jobs, posting jobs and recruiting as an employer, participating in the community, and accessing outage and industry data you are authorized to use. You agree that you will not:

  • Use the Site for any unlawful purpose or in violation of these terms.
  • Damage, disable, overburden, or impair the Site, or interfere with anyone else's use of it.
  • Scrape, harvest, or bulk-collect content, resumes, job listings, or other users' information by automated means or without our permission.
  • Attempt to access data, accounts, or systems not intentionally made available to you.
  • Resell, redistribute, or create derivative products from Site content or data except as expressly permitted by a paid plan or written agreement.

Your Content and Community Areas

The Site includes forums, a gallery, ratings, profiles, and messaging that let you post content and communicate with others (collectively, "Community Areas"). You are solely responsible for what you post. You agree not to post material that is unlawful, defamatory, harassing, obscene, infringing, or that violates another person's rights, and not to upload malware, harvest others' contact information, or send unsolicited advertising. Posting of classified, export-controlled, safeguards, or other security-sensitive information is strictly prohibited.

You retain ownership of what you post, but you grant NukeWorker a non-exclusive, royalty-free license to host, display, and distribute it on the Site for the purpose of operating the service. We have no obligation to monitor Community Areas, but we may review and remove content, and suspend or terminate access, at our discretion. See our Code of Conduct and Anti-Spam Policy.

Paid Services

Some services are paid, including employer job postings and plans, outage schedule subscriptions, and related data products. Fees, billing periods, and any refund terms are shown at the point of purchase or in the applicable plan. Payments are processed by third-party payment processors; we do not store full card numbers. We may suspend or terminate paid services for non-payment or for violation of these terms.

Intellectual Property

All material on the Site, including text, photographs, graphics, data, code, and software, is protected by copyright, trademark, and other laws. Except for content you post, it is owned by or licensed to NukeWorker and may not be copied, distributed, or used except as these terms or a written agreement allow.

Copyright Complaints (DMCA)

We respect the intellectual property of others. If you believe content on the Site infringes your copyright, please notify us through our contact page with: a description of the work, the location (URL) of the material on the Site, your contact information, a statement that you have a good-faith belief the use is not authorized, and a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act on the owner's behalf. We remove or disable infringing material and may terminate repeat infringers.

Links to Third-Party Sites

The Site may link to sites we do not control. We are not responsible for the content of those sites, and a link does not imply our endorsement. You access linked sites at your own risk.

Liability Disclaimer

The information, software, products, and services on the Site may include inaccuracies or errors and are provided "as is" without warranty of any kind, to the maximum extent permitted by law. NukeWorker and its suppliers make no representations about the suitability, reliability, availability, timeliness, or accuracy of the Site for any purpose.

Outage schedules, projections, and other data on the Site are provided for general information only. They are not official plant records and should not be relied upon for operational, safety, medical, legal, or financial decisions. Consult the appropriate authority or a qualified professional for advice specific to your situation.

To the maximum extent permitted by law, NukeWorker is not liable for any direct, indirect, incidental, or consequential damages arising out of your use of, or inability to use, the Site.

Termination and Access Restriction

We may, in our sole discretion, terminate or restrict your access to the Site or any part of it at any time, with or without notice.

Governing Law

These terms are governed by the laws of the State of Michigan, U.S.A. You consent to the exclusive jurisdiction and venue of the state and federal courts located in or serving Berrien County, Michigan, U.S.A. for any dispute arising out of or relating to the Site. Nothing in these terms limits our right to comply with governmental, court, or law enforcement requests relating to your use of the Site.
